2. Object and Legal Regime

The contracted service consists of the seasonal rental of a furnished dwelling. By accepting these conditions, the client declares that the contract is governed by Título III de la Ley 29/1994, de Arrendamientos Urbanos (Title III of Law 29/1994, on Urban Leases - LAU) (leases for use other than housing) and not by tourist regulations or permanent housing laws.

3. Reinforced Declaration of Causality (Documentation)
Essential condition for contract validity

1. Mandatory Documentation

The TENANT must attach or send before entry a copy of the document justifying temporality (e.g., temporary employment contract, university enrollment, certificate of renovation in habitual residence, payroll in another city).

2. Habitual Residence

The TENANT acknowledges having their permanent and habitual domicile at the address appearing on their identity document (ID/Passport) and undertakes to maintain it valid during the lease.

3. Prohibition of Registration (Empadronamiento)

Registering on the municipal census (empadronarse) in the rented property is expressly prohibited. Any attempt to use the dwelling as a permanent home will be considered a serious breach and cause for immediate resolution of the service.

3.1. Mandatory Identification of Occupants (Police Registry)

In strict compliance with Citizen Security regulations (Real Decreto 933/2021), it is MANDATORY to identify all persons over 14 years of age staying in the property.

Obligation

Provide complete details (Name, ID/Passport) of all occupants before check-in

Restriction

Only duly identified persons may stay. Unidentified persons constitute serious breach

4. Duration and Extensions

The contract will have the duration determined in the reservation.

Check-in / Check-out

Times will be flexible and set by mutual agreement upon prior communication. In default of express agreement, check-in from 14:00h and check-out before 12:00h.

Automatic Expiration

The contract will expire automatically upon term expiration, without need for notice (Art. 1569 del Código Civil). Tacit renewal (tácita reconducción) shall not apply.

5. Price and Taxes

Individuals

The price is as agreed in the reservation and includes the use of the dwelling and furniture.

Payment Method

100% of the first month in advance. Subsequent monthly payments via automatic charge (Stripe/Transfer) within the first 5 days.

6. Legal Deposit (Article 36 LAU)

The TENANT delivers the sum equivalent to two months of rent, as a legal deposit (fianza).

Payment: This amount must be effectively paid (by transfer or card charge) before the keys are handed over. Pre-authorizations or blocks are not accepted for this concept.
Deposit: Said deposit will be deposited by the LESSOR in the competent body of the Comunidad de Madrid (IVIMA) in accordance with current regulations.
Refund: It will be returned at the end of the contract by bank transfer, after verification of the absence of damage or outstanding debts and once recovered from the competent body, within the legal period.
7. Supplies and Services

Supplies (Consumption Cap)

The price includes supplies (water, electricity, gas, internet) up to a maximum amount of 300€/month in total. The excess over said amount will be paid by the TENANT along with the next month's rent or deducted from the deposit.

Cleaning

Cleaning of the property is offered at entry and exit. Cleaning services, change of bed linen, or services typical of the hotel industry are NOT offered during the stay. Any extra cleaning service requested will be invoiced independently.

8. Conservation and Access to the Dwelling

Repairs

The LESSOR will carry out repairs necessary for habitability, except for misuse by the tenant. The TENANT is responsible for small repairs due to ordinary use (light bulbs, etc.).

Restricted Access

The TENANT authorizes access to the LESSOR or technicians exclusively to carry out necessary or urgent repairs for habitability, with prior notice and agreement on the time of intervention, except in cases of imminent force majeure (e.g., fire, flood).

9. Prohibitions and Rules of Coexistence
Strictly prohibited (Art. 27.2 LAU)

Assign or Sublet

Total or partial subletting and assignment of the contract are prohibited

Pets

Not allowed, unless express written authorization from the Property

Smoking

Prohibited smoking inside

Annoying Activities

Parties and noise are prohibited from 22:00h

10. Cancellation and Early Withdrawal

Reservation Cancellation

Cancellation conditions for the reservation prior to the start of the lease are governed by the Cancellation Policy published on the website or attached to this contract.

Early Withdrawal

In case of withdrawal by the TENANT before the end of the agreed term, they must indemnify the LESSOR with the payment of the remaining rents until the end of the contract, unless the dwelling can be re-rented for the same period.

11. Data Protection (GDPR)

Personal data will be processed by Ibernova Soluciones S.L. for the purpose of managing the contractual relationship and complying with legal obligations (tax, traveler registry). The legal basis is the execution of the contract. Data will be retained during the legal periods provided (e.g., 5 tax years). 12. Jurisdiction

For any dispute, the parties submit to the courts and tribunals of the place where the property is located (Madrid).
